Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Dwella mobile application (the "App"). These Terms govern your access to and use of the App.
1. Acceptance of Terms
By accessing or using Dwella, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
Dwella is a household task management application that allows users to:
- Create, manage, and track household tasks
- Organize grocery lists
- Schedule tasks with calendar integration
- Share tasks and lists with household members
- Receive notifications and reminders
3. Account Registration
3.1 Account Creation
- You must create an account to use the App
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account credentials
- You must be at least 13 years of age to use the App
3.2 Household Management
- Users can create or join a household
- Each household has one administrator ("Household Admin")
- The Household Admin has additional privileges including subscription management and member management
- Household Admins can invite or remove members from their household
4. Subscription Terms
4.1 Free Tier
- Dwella offers a free tier with limited features
- Free tier users have limitations on the number of tasks and grocery items
4.2 Premium Subscription
- Premium subscriptions unlock unlimited tasks, grocery items, and additional features
- Available subscription plans:
- Monthly subscription
- Yearly subscription
- All subscriptions include a 7-day free trial for new subscribers
- Subscriptions are purchased by the Household Admin and cover all members of that household
4.3 Billing
- Subscriptions are billed through Apple's App Store
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage your subscription and turn off auto-renewal in your Apple Account Settings
4.4 Free Trial
- New subscribers are eligible for a 7-day free trial
- You will not be charged during the trial period
- To avoid charges, cancel at least 24 hours before the trial ends
- Upon trial expiration, your subscription will automatically convert to a paid subscription
4.5 Cancellation
- You may cancel your subscription at any time through your Apple Account Settings
- Cancellation takes effect at the end of the current billing period
- No refunds will be provided for partial subscription periods
- Upon cancellation, you and your household members will revert to the free tier at the end of the billing period
4.6 Household Subscription Access
- When a Household Admin purchases a subscription, all household members receive premium access
- If you leave a household with an active subscription, you will lose premium access
- If you are removed from a household by the Household Admin, you will lose premium access
- If the Household Admin cancels the subscription, all household members will lose premium access at the end of the billing period
4.7 Refunds
- All purchases are processed through Apple's App Store
- Refund requests must be made through Apple according to their refund policy
- We do not have the ability to process refunds directly
5. User Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Share your account credentials with others
- Attempt to gain unauthorized access to the App or other users' accounts
- Upload or transmit viruses or malicious code
- Harass, abuse, or harm other users
- Use the App to spam or send unsolicited messages
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
6. Content and Data
6.1 Your Content
- You retain ownership of any content you create in the App (tasks, grocery lists, notes, etc.)
- You grant us a license to store, process, and display your content to provide the service
- You are responsible for the content you create and share
6.2 Data Storage
- We use cloud storage services to store your data
- Your data is associated with your account and household
- Data may be deleted if your account is inactive for an extended period
6.3 Backup
- While we take reasonable measures to protect your data, you are responsible for maintaining your own backups
- We are not liable for any loss of data
7. Intellectual Property
- The App and all its content, features, and functionality are owned by Dwella and are protected by copyright, trademark, and other intellectual property laws
- You may not copy, modify, distribute, sell, or lease any part of the App
- The Dwella name and logo are trademarks and may not be used without permission
8. Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
9. Third-Party Services
The App uses third-party services including:
- Apple's App Store for payments
- Firebase for data storage and authentication
- RevenueCat for subscription management
Your use of these services is subject to their respective terms and conditions.
10. Disclaimers
10.1 "As Is" Service
- The App is provided "as is" and "as available" without warranties of any kind
- We do not guarantee that the App will be uninterrupted, secure, or error-free
- We do not warrant that the results obtained from using the App will be accurate or reliable
10.2 No Professional Advice
- The App is for personal household management only
- It does not provide professional, financial, legal, or medical advice
11. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the subscription in the twelve months preceding the claim
- Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you
12. Indemnification
You agree to indemnify and hold harmless Dwella, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another user
- Your content or data
13. Termination
13.1 By You
- You may delete your account at any time through the App settings
- Deleting your account will not cancel any active subscriptions. This must be done directly through Apple's App Store.
13.2 By Us
- We reserve the right to suspend or terminate your account if you violate these Terms
- We may discontinue the App at any time with or without notice
- Upon termination, your right to use the App will immediately cease
13.3 Effect of Termination
- Upon termination, your data may be deleted
- You will not be entitled to any refund of subscription fees
- Provisions that should survive termination will remain in effect (including liability limitations and dispute resolution)
14. Changes to Terms
- We reserve the right to modify these Terms at any time
- We will notify you of material changes through the App or via email
- Your continued use of the App after changes constitute acceptance of the new Terms
- If you do not agree to the changes, you must stop using the App
15. Changes to the App
- We reserve the right to modify, suspend, or discontinue any feature of the App at any time
- We may also change subscription pricing with advance notice
- Price changes will not affect active subscriptions until the next renewal period
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
17. Dispute Resolution
17.1 Informal Resolution
- Before filing a claim, you agree to contact us to attempt to resolve the dispute informally
- We will attempt to resolve disputes in good faith
17.2 Arbitration
- Any disputes that cannot be resolved informally shall be resolved through binding arbitration
- The arbitration will be conducted in accordance with the American Arbitration Association rules
- You waive your right to participate in a class action lawsuit or class-wide arbitration
17.3 Exceptions
- Either party may seek injunctive relief in court for intellectual property infringement
- Either party may pursue claims in small claims court
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Dwella regarding the use of the App and supersede any prior agreements.
20. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
21. Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
